Note: Circuit Court Tipton Co., IN dated Thursday 22 Dec 1887 Term of 1887 shows the petition to adopt filed by Rosalia A. Kessler for Cora E. Vawter. It states that Cora E. Vawter is the orphan child of George W. Vawter her father and his wife Mary E. Vawter that the mother died 12 Apr 1885 and the father died 18 Sep 1887. It said that Cora E. Vawter now is 6 years old having been born 28 Aug 1881 and that she has lived with Rosalia A. Kessler since the death of her mother. The court granted the petition to adopt as heir in law and changed her name to Cora E. Kessler. (Note: this is why there has been difficulty in located any records under the name Vawter)

DAVID VAWTER, Bond for Ferry across Sabine
Know all men by these presents that I, DAVID VAWTER, Principal, & SETH SHELDON, Security, are held and firmly bound unto L.H.Dilliard, Chief Justice in office of said county, in the penal sum of one thousand dollars, good and lawful money for the payment of which, well & truly to be made, we bind ourselves, one and each of us, our heirs and assigns, severally & firmly by these presents. Signed and sealed this 3rd day of September 1844. The condition of the above bond is such that whereas the above bound, DAVID VAWTER, has obtained a License to keep up and establish a Ferry on the Sabine River at the GRAND BLUFF. Now if the said, VAWTER, shall well and truly comply with the law respecting the establishment of a Ferry, then this obligation to be null and void, otherwise to remain in full force & virtue this day & date above.

The petition of Nicholas V. Board with respect presents to the Honorable Judge of Probate of said county. DAVID VAWTER died without a will as far petitioner knows; that the estate of said VAWTER is indebted to your petitioner in the sum of two hundred and twenty dollars by note with a credit thereon of one dollar and 87 cents. Petitioner prays your Honor to grant your petitioner letters of administration on the estate of said DAVID VAWTER, dec'd who died on the 12th day of July 1845. April 8th 1846.

Ordered by the Court that LUCINDA VAWTER, Administratix of the Estate of DAVID VAWTER, dec'd., be allowed to retain in her hands for her and the use of her children, Minors, the full amount of the Inventory of said Estate. It not being the amount allowed her by law amounting to four hundred and thirty six dollars and seven cents.
PANOLA COUNTY, TEXAS DEEDS, VOLUME A, Page 82:
LUCINDA VAWTER, resident and owner of land in the Duboise Survey, made Bond for $1000.00 to operate a Ferry at Grand Bluff across the Sabine River, 18 January 1847.
Note: David Vawter served in the Revolutionary War as a member of Captain Ambrose Madison's Company of Foot in the Regiment of Volunteer Guards at the Barracks in Albermarle county. He served from January 17, 1779 to June 1, 1779. (source: Virginia Magazine of History and Biography,1893-1894).
Also according to the War Department, he enlisted as a private in Captain John Camp's Company in the First Virginia State Regiment, commanded by Colonel George Gibson, March 1, 1777 to serve 3 years. His name last appeared on the company muster February, 1778.
David Vawter's wife has been a source of confusion for many years, and a lot of researchers have thought David Vawter married Mary Rucker, daughter of Ephraim Rucker. W.T. Vawter made this mistake in his Sons of American Revolution application. And they didn't know the difference.
To recap: Ephraim Rucker's daughter Mary Rucker married William Vawter. Ephraim's sister Mary Rucker married William Offill. And their daughter Mary (Offill) married David Vawter. Per Rucker Family Genealogy.
The Virginia Genealogist magazine:
"David Vauter, Orange. Died at the Albemarle Barracks during the war, worth nothing at all. He lived near to William Lucas of Orange and his widow lived near him (Lucas) for several after the death of her husband is great distress."
