The Will of John James, Sr,
Dated November 23, 1834 and recorded November 6, 1840

In the name of God amen. I John James Sen of the County of Rutherford and State of Tennessee being of sound and perfect mind and memory do make this my last will and testament in manner and following.
I lend to my beloved wife Eliz. James during her natural life three negro slaves…….also the house and land which I now reside on with the household and kitchen furniture. Also three cows and calves, two horses, two sows and goats and my sheep be there few or many also the plantation tools with the cart and oxen and after her death I give the above named land (?) to my son John James and his heirs forever and for the balance of the property that I have loan to my wife it is my desire that after her death that it should be equally divided among all my children to them and their heirs for ever.
I give to my son Robert L James two negroes Lucy and Archer to him and his heirs forever.
I give to my son John James two negroes Nathan and America to him and his heirs for ever.
I lend to my daughter Frances Anderson during her life two negroes Judah and Rachel and after her death to be equally divided amongst all her children to them & their heirs forever.
I lend to my daughter Eliz. Braswell during her life one negro girl named Hannah and after her death it is my wish the said negro be divided equally among her children to them and theirs forever.
I give to my daughter Mary James two negroes Sarah and Thomas to her and her heirs forever.
I lend to my daughter Sarah Foster during her life one negro named June and after her death to be equally divided amongst all her children to them & their heirs forever.
I lend to my daughter Nancy Foster during her life for the benefit of her children one negro boy named Peter and at the death of my daughter Nancy to be equally divided amongst all her children to them and their heirs for ever.
I lend to my daughter Martha Hobson during her life two negroes Mancery & Creasy and after her death to be equally divided amongst all her children to them and their heirs forever.
I lend to my daughter Winifred James during her life three negroes Ned, Mary and Henry and after her death it is my wish that Elizabeth James daughter of Winifred James should have the sd three negroes to her and her heirs forever .
All the balance of my estate whither named or not named I lend to my wife during her life and after her death I give ….to my son Robert James and his heirs for ever.
The balance of the property that I have loaned to my wife and not particularly named I wish to be equally divided amongst all my children at my wifes death confiding in trust (?) and faithfulness of my son John James and Benjamin (Marable Sen.?) **…..I appoint them exrs. To this my last will & testament. (** there was a Benjamin Marable listed in the 1850 Rutherford Tn. Census)

Mattie Frances James Sheppard Long made the application February 14, 1901 on behalf of her two children, William Ernest and Bessie Sheppard (for enrollment as citizens of the Cherokee Nation). She did not qualify for membership herself because after the death of her Cherokee husband, she had remarried to a white man.
Because Mattie could not produce the marriage certificate, Susan Lynch, wife of Judge Lynch, gave a statement.
She said that her husband performed the marriage ceremony at their house. (September 25, 1884) She said that William Sheppard had been married once before to a cousin of hers, Mary Ann Wilson, who had died.
When asked for the names of William's parents, Mattie replied Jack and Josephine. She never knew either one, they had been dead for years before she met William. (Josephine could have been a step-mother for all she knew.) "Jack" had been married 4 times.

I am sure that I ougt no longer to delay addressing you upon a subject with which is concerned not only my own happiness but also my duty toward your self. I have had Miss Matties company since she came to this place. I can say to you she has won all my love and affections and I will do all there is in my power to make her happy the rest of her dayes. She has also agreed to give me her heart and hand and it is her request for me to drop you a few lines wich I have done to gratify her wishes.

Know all by these present that I Wm. P. Sheppard, of Canadian District, Cherokee Nation, being in my sound and disposing mind make this my will. That Charley Sheppard is to have Fifty Dollars in cash as his portion to my estate. The remainder of my property and effects, personal and real and mixed of what nature and kind soever and wheresoever the same shall be at my death to go to my wife Mattie Sheppard & my two children I have by her and for them to have and keep, jointly while the said Mattie Sheppard lives. At her death the property and effects as I have mention above to go to my two children Earnest and Bessie Sheppard, my farm situated on the Dirdene Creek and joins Ike Beuge's place on the southern side is not to be sold but keep for Earnest & Bessie Sheppard. Annie Smith has no interest in my estate whatever, she is no child of mine and I never has claimed her as one.
In witness wherof I herewith set my hand in presents of these witness.

Mattie Sheppard Long died January 10, 1951:

SERVICES FOR MRS. LONG TO BE FRIDAY:
Last rites for Mrs. mattie Long, 87, who died of a heart attack Tuesday night, will be at 2:30 p.m. Friday at the First Baptist church. Rev. L. C. Robbins will officiate.
Burial will be at Woodlawn cemetery under Musgrove funeral home direction.
Mrs. Long,who had lived here for many years, is survived by two daughters, Mrs. Sallie McGinnis, Claremore, Mrs. Bessie Johnson, Pipe Creek, Tex. and six grandchildren and six great-grandchildren.
